Decree Settling Final Account and of Distribution.

Julia Bolado Ashe, executrix of the last will and testament of Joaquin Bolado, deceased, having heretofore rendered and filed herein an account and report of her administration of said estate, which account was for a final settlement, and having with said account filed a petition for the final distribution of said estate;

… Joaquin Bolado died testate on the 28th day of November, 1894, leaving a last will and testament…

…Personal property as follows: Growing crops, hay, three horses, two wagons, harness and saddle, four cows, household furniture, poultry, all in the State of California…

All those certain parts of the Rancho Santa Ana Y Quien Sabe situated in the County of San Benito, State of California, and more particularly described as follows, to-wit:

to the west line of the aforesaid road and thence along said line to the point of beginning, containing in all Seven Hundred and one-half (700 50/100) acres, and being parcel of land conveyed to Joaquin Bolado by one Juan Yndart December 23, 1873, by deed recorded in Book “E” of Deeds, page 128, San Benito County Records;

Also that portion of the Rancho Quien Sabe conveyed by Estanislaus [Estanislao] Hernandez December 15, 1873, as per deed recorded in Book “e” of Deed, at page 127 et seq. of the San Benito County Records, and particularly described as follows:

Beginning at a stake on the South boundary of the Rancho Santa Ana Y Quien Sabe being station one (1) of division survey of said rancho, and thence running:

North 45 degrees East 39.55 chains,
South 9 degrees West 27.30 chains,
West 23.00 chains
to the point of beginning, containing Thirty one 30/100 (31 30/100) acres.

The whole of said tract containing Nine Thousand Three Hundred and nine and 81/100 (9309 81/100) acres, and being commonly known as the Santa Anita Rancho.

Also that certain tract of land situate, lying and being in the County of San Benito, State of California, describe as follows to-wit:- Lots:

Joaquin Bolado To Estanislao Hernandez. This conveyance made this twenty second day of the month of March A.D. Eighteen hundred and seventy five by Joaquin Bolado of the City and County of San Francisco in the State of California Grantor to Estanislao Hernandez late of the County of San Benito and now of the County of Santa Clara in the said State of California Grantee.

Witnesseth That for and in consideration of the sum of One hundred ten thousand dollars (110,000.00) in gold paid and secured to be paid by the said Grantee to the said Grantor the said Grantor hath this day granted and conveyed and by these Presents doth grant and convey unto the said Grantee and to his heirs executors administrators and assigns forever all those certain tracts of land situate in the county of San Benito in Said State and being part of the Rancho called and Known as Santa Ana and described as follows viz

Together with all the rights, privileges and appurtenances thereunto belonging or in anywise appertaining

May 14, 1873 — Teresa Arques de Casals (to Martin Murphy) wife of Buenaventura Casals of Barcelona grants to Martin Murphy for $4000 her share of 7,935 acres of the Rancho Santa Ana and lots in Hollister.

1872-12-12: Murphy buys Half of Arques Estate 7,935 ac of Rancho Santa Ana & Hollister Lots from Spanish Heirs Before Distribution

Thursday, December 12, 1872 – José G. Arques Estate: from Spanish cousins to Martin Murphy.

José G Arques et. al. (cousins in Spain named in his will) granted to Martin Murphy their share of 7,935 acres of Rancho Santa Ana and lots in Hollister — before distribution — so Murphy becomes entitled to 1/2 the José G. Arques estate (the shares of the cousins in Spain) in this grant to Martin Murphy of Santa Clara for $24,000.

It refers to partition deed from Bolado to Arques of 6/8/1869, and a 11/11/1871 deed from Bolado to Arques.

1872-12-02: Half of Arques Estate Sold Conditionally to Juan Yndart

Monday, December 2, 1872 – Owners of half of the Arques estate to Juan Yndart.

Brothers Joaquin R. Arques of Santa Clara County and Luis and Clemente Arques of Monterey County agreed to sell:

  • lots 24 and 20
  • the part of lot 19 west of Santa Ana Valley Road
  • lots 23 and 25, the eastern boundary of the two last named lots being the Santa Ana Valley Road as now traveled
  • the whole tract known as the "pasture field" being enclosed and a part of Santa Ana Rancho, and currently leased to Yndart

…to Yndart (conditional on securing title) who paid $15K 1/1/1873 in gold in SF.

The brothers needed time to complete title ownership. Yndart was to pay $15K 1/1/1874 in gold in San Francisco the final day.
